Current Issues Updated Timeline
Spring 2021
Board of Pharmacy (BOP) begins targeted, unannounced inspections of medical spas and issue citations. The most common citation is for using Botox as a multi-dose vial when labeled single use. AMPNH members hire a legal team to fight these citations since reconstitution of neurotoxin off label with bacteriostatic saline for multi-use is industry norm and best practice.
Late Spring 2021
AMPNH’s legal team is able to stop additional medical spa inspections and place citations on hold. Legal team negotiates that no providers will be singled out over this issue, however, the BOP fails to acknowledge that industry standard use of neurotoxin is acceptable.

After the hearing, AMPNH spoke with many committee members to express our concerns regarding erroneous information during the study session. During these productive conversations, AMPNH learned that more legislation regulating the medical spa industry will occur later this year.

AMPNH was hard at work, AMPNH and its meeting with legislators and agency leadership at the Office of Professional Licensure and Certification (OPLC). The OPLC oversees the administration of forty-seven occupational licensing boards; these Boards, Councils, and Commissions directly regulate their professions. During our meeting with the OPLC, representatives of AMPNH spoke with OPLC about how a medical spa operates, presented feedback on previous legislation, and answered questions regarding our industry. In addition, AMPNH discussed with the OPLC ways in which our organization can be helpful to them in the future. Meeting and building a relationship with OPLC is critical to the medical spa industry.
